Spokane Veteran’s Benefits/Aid/Attendance Lawyers
The “Veteran Aid and Attendance Pension” is a special Veterans Program designed to help disabled veterans and/or their surviving spouses receive the financial support necessary to ensure their continuing care in their own home or an assisted living or nursing home setting. Benefits may also be available for house-bound individuals who require daily assistance to maintain their health, dignity and safety. Factors such as your assets, income, and your medical diagnosis impact whether or not you can qualify for Aid and Attendance (A&A). The elder law attorneys at the Moulton Law Offices can help you establish eligibility and guide you through the process so you can successfully claim the benefits and support available to you. Call our experienced Spokane veteran’s benefits/Aid and Attendance lawyers today to get started.
How Does Aid & Attendance Work?
Aid and Attendance is a tax-free benefit that is paid directly to the qualified applicant. The benefit is paid on top of any other existing resources you use to pay for care. A&A can be used to pay for services such as an in-home care provider or residence in an assisted living facility or nursing care facility.
Who Is Eligible for Veterans Aid & Attendance Benefits?
VA Aid and Attendance is available to veterans who served at least 90 days of active duty, including at least one day served during a time of war. In addition, the cost of care provided must generally exceed the individual’s annual income.
Additionally, A&A includes a medical component in order to qualify. A&A eligibility must be based on one of the following:
- A medical reason why you cannot live independently and need regular assistance and care with Activities of Daily Living (ADLs) such as bathing, dressing, using the bathroom, feeding, adjusting your prosthetic devices, or protecting yourself from the hazards of your daily environment
- Illness or disability requires you to stay in bed for at least a large portion of the day (bedridden)
- Disability has caused a loss of mental or physical abilities requiring you to receive care in a nursing facility
- Eyesight is severely limited (corrected to 5/200 or less visual acuity in both eyes or concentric contraction of the visual field to five degrees or less)
Housebound benefits are another benefit similar to Aid and Attendance. If you receive a VA pension and spend most of your time at home due to a permanent disability, you could be eligible for Housebound benefits.
What Is VA Accreditation?
The U.S. Code clearly states that no one can assist an applicant in preparing a claim for benefits unless they have been “recognized for such purposes” by the VA. The VA accredits claims agents and veterans service organizations as well as attorneys, who must be in good standing with the state bar and demonstrate they have the experience, knowledge and moral fitness to be accredited. Make sure that whoever you use is VA accredited so you know you won’t be taken advantage of by an untrustworthy individual or organization.
At Moulton Law Offices, you’ll find a VA Accredited attorney who can evaluate your particular situation to determine whether you qualify and assist you in applying for A&A benefits. We can also guide you through the application process to make sure you include the right kind of detailed evidence that proves your eligibility and need for Aid and Attendance or Housebound care.
